Speeding is driving in excess of the posted speed limit and has gradual increase in punishments depending on how many miles over the speed limit you are going. Under section 39:4–98 – RATES OF SPEED, the driver will be assessed two (2) points for going 1-14 mph over the speed limit, four (4) points for going 15-29 mph over the speed limit, and five (5) points for going 30 or more mph over the speed limit.

Careless driving is one of the most common traffic offenses in New Jersey. Careless driving means driving with absence of alertness and could mean everything from daydreaming, reaching for something in the vehicle, or looking at something outside of the vehicle. You can get a ticket for careless driving for making a lane change too suddenly, talking on a cell phone, pampering kids on the back seat while driving and for cases where there is an accident or someone is injured.

Under section 39:4-97 CARELESS DRIVING, the ticket subjects the driver to receiving 2 points on their driving record. Reckless Driving N.J.S.A. 39:4-96 is a serious moving violation and the punishments are typically higher than most other moving violations. The violation can carry five points to the driver, up to $200 fine and up to 60 days in jail for the first offense and up to three months in jail for a second or subsequent offense. The license suspension can be up to 90 days for a first offense and up to 180 days for the second and subsequent offenses.
